1. Introduction

This Privacy Policy (this "Policy") explains how DeepReel Technologies, Inc. and its affiliates, including DeepReel Limited (collectively, "DeepReel," "we," "us," or "our"), collect, use, disclose, retain, and protect personal information when you access or use our websites, applications, software, APIs, AI video generation services, avatar tools, voice tools, templates, content creation features, and related services (collectively, the "Services").

DeepReel enables users to create and edit AI-assisted videos, avatars, scripts, voices, images, and related content. Because these Services may involve user-uploaded content, generated outputs, face imagery, voice data, and other potentially sensitive information, this Policy describes the categories of information we process and the choices you may have.

By using the Services, you acknowledge that we process personal information as described in this Policy. If you do not agree with this Policy, you should not use the Services.

2. Scope and Roles

This Policy applies to personal information that DeepReel processes in connection with the Services, including information about website visitors, account users, prospective customers, business contacts, and individuals who interact with us.

Depending on the context, DeepReel may act as a controller, business, or similar responsible party when we determine the purposes and means of processing personal information, such as for account administration, billing, service improvement, security, analytics, marketing, legal compliance, and our own product operations.

When a business customer uses the Services to process personal information on behalf of its own users, employees, contractors, customers, or other individuals, that customer may be the controller or business responsible for that information, and DeepReel may process the information on the customer's behalf under the applicable customer agreement and our Terms of Service. Until DeepReel publishes or enters into a separate data processing addendum, business customers should contact support@deepreel.com with any questions about data processing terms or privacy requirements.

This Policy does not apply to third-party websites, platforms, applications, services, or integrations that we do not own or control, even if they are linked to or integrated with the Services.

3. Personal Information We Collect

We collect personal information from you, from your device, from your use of the Services, from third parties, and from content you choose to upload, generate, or share through the Services.

3.1 Information you provide to us

  • Account and contact information. Name, email address, username, password or authentication credentials, company or organization name, role, preferences, and other account details.
  • Billing and subscription information. Subscription plan, billing status, credits, invoices, purchase history, transaction records, and payment-related information. Payment card and financial information may be processed by our payment providers, such as Stripe, and we do not need to store full payment card numbers.
  • User inputs and uploaded content. Text, prompts, scripts, documents, PDFs, URLs, images, videos, audio recordings, voice recordings, brand assets, logos, templates, instructions, metadata, and other materials you submit to the Services.
  • Generated outputs. Videos, avatars, voices, scripts, captions, images, edits, exports, thumbnails, project files, and other outputs generated, edited, or stored using the Services.
  • Avatar, likeness, and voice information. Information you provide to create, personalize, verify, or use avatars, voice features, image-based features, or other synthetic-media features, including face imagery, body imagery, voice recordings, consent materials, and related metadata.
  • Communications and support information. Messages, emails, support tickets, survey responses, feedback, attachments, call notes, and other information you provide when you contact us or interact with support, sales, or customer success.
  • Marketing and event information. Information you provide when you subscribe to communications, register for events, request demos, download content, or interact with DeepReel on social media or through marketing campaigns.

3.2 Information collected automatically

  • Device and browser information. IP address, device type, operating system, browser type, language settings, mobile identifiers, and similar technical information.
  • Usage information. Pages viewed, features used, projects created, credits consumed, generation requests, timestamps, referrer URLs, approximate location derived from IP address, logs, clickstream data, and interactions with the Services.
  • Performance and diagnostic information. Error logs, crash reports, latency, system activity, feature performance, and troubleshooting information.
  • Cookie and tracking information. Information collected through cookies, pixels, SDKs, local storage, and similar technologies, as described in Section 7.

3.3 Information from third parties

  • Login and authentication providers. If you log in through a third-party identity provider, we may receive information such as your name, email address, profile image, organization, and authentication status.
  • Integrations and connected services. If you connect DeepReel to third-party services, we may receive information necessary to provide the integration, such as account identifiers, files, permissions, metadata, or content that you authorize us to access.
  • Vendors and business partners. We may receive information from service providers, analytics providers, fraud-prevention providers, payment processors, marketing partners, sales platforms, and other business partners.
  • Publicly available or customer-provided information. We may process publicly available information or information provided by customers where permitted by law and consistent with the Services, including for product improvement, safety, fraud prevention, or AI model research and development where applicable.

4. Sensitive Information, Face Data, Voice Data, and Biometric Information

Some DeepReel features may process images, video, audio, voice recordings, facial imagery, body imagery, likeness information, or similar information to create, personalize, verify, or generate avatars, voices, synthetic media, or other outputs. Depending on applicable law and how the information is used, some of this information may be considered sensitive personal information, biometric information, biometric identifiers, or biometric data.

DeepReel processes this information to provide requested features, create and personalize avatars and voices, verify authorization or consent where applicable, protect against misuse and impersonation, improve safety and quality, provide support, and comply with legal obligations. We do not use face data or voice data to infer sensitive characteristics about individuals, such as race, religion, health status, political views, or sexual orientation.

You must have all necessary rights, permissions, and consents before uploading or using any person's image, video, voice, likeness, biometric information, or personal information with the Services. You may not submit face data, voice data, or likeness data of minors or other individuals unless you have all required legal authority and the use is permitted by our Terms of Service and Acceptable Use Policy.

4A. Biometric Identifiers and Biometric Information

For features that create or use Voice Clones, AI Avatars, or other outputs derived from voice recordings or facial imagery, DeepReel may collect, store, and use biometric identifiers and biometric information as those terms are defined under applicable law, including the Illinois Biometric Information Privacy Act, 740 ILCS 14.

Purpose. DeepReel collects and uses biometric identifiers solely to provide the features you or your business customer request — to create, personalize, train, and operate Voice Clones, AI Avatars, and synthetic media outputs — and to verify authorization and consent, prevent misuse, and comply with applicable law.

Term. DeepReel will retain biometric identifiers and biometric information only as long as reasonably necessary for the purpose for which the data was collected, and in no event longer than three (3) years following your last interaction with DeepReel or the date the initial purpose for collection is satisfied, whichever occurs first. DeepReel will permanently destroy biometric identifiers in accordance with this retention schedule.

Consent. By using features that create Voice Clones, AI Avatars, or other outputs derived from biometric identifiers, and by submitting voice recordings, facial imagery, or similar data, you provide written consent to DeepReel’s collection, storage, and use of those biometric identifiers and biometric information for the purposes and term described above. Where you submit such data on behalf of any other individual, you represent that you have obtained that individual’s written consent on substantially the same terms.

No sale or profit. DeepReel does not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information.

Disclosure. DeepReel will not disclose biometric identifiers or biometric information except as required by law, court order, or warrant, or as authorized by you or, where applicable, the individual to whom the biometric identifier or biometric information pertains.

Security. DeepReel stores, transmits, and protects biometric identifiers and biometric information using the reasonable standard of care for the industry and in accordance with the same or greater standards we use to protect other confidential and sensitive information.

5. How We Use Personal Information

We use personal information for the following purposes:

  • Providing the Services. To create and manage accounts, authenticate users, provide access, process uploads, generate outputs, create and personalize avatars and voices, operate projects, store content, provide credits, and deliver requested features.
  • Billing and account administration. To process payments, manage subscriptions, credits, invoices, taxes, renewals, cancellations, non-payment, and account communications.
  • Customer support. To respond to requests, investigate issues, troubleshoot errors, provide technical assistance, and improve support processes.
  • Safety, security, and abuse prevention. To detect, prevent, investigate, and respond to fraud, impersonation, unauthorized access, misuse, policy violations, unlawful activity, security incidents, spam, synthetic-media abuse, and harmful content.
  • Content moderation and enforcement. To review, moderate, block, remove, label, restrict, or investigate inputs, outputs, accounts, workspaces, projects, avatars, voices, or other content where we believe our Terms of Service, Acceptable Use Policy, this Policy, applicable law, or third-party rights may be violated.
  • Product improvement and analytics. To understand usage, maintain and improve the Services, develop new features, improve quality and reliability, debug errors, conduct research, evaluate model and feature performance, generate aggregate or deidentified insights, and enhance user experience.
  • AI model research, development, training, and improvement. To train, fine-tune, evaluate, test, and improve AI models and systems where permitted by applicable law, your plan, your settings, and this Policy. See Section 6 for additional details and opt-out information.
  • Marketing and communications. To send product updates, announcements, offers, newsletters, event invitations, and other communications where permitted by law. You may opt out of marketing emails at any time, but we may still send non-marketing administrative or service-related messages.
  • Legal, compliance, and business purposes. To comply with law, respond to legal process, enforce our agreements and policies, protect rights, resolve disputes, conduct audits, maintain records, and support corporate transactions.

6. AI Model Training, Product Improvement, and Opt-Out

DeepReel may use some personal information and content submitted to or generated through the Services for AI model research, development, training, evaluation, testing, and improvement, depending on your subscription plan, feature, account settings, and applicable customer agreement. Customer data is not excluded from such uses by default unless your plan, settings, or written agreement says otherwise.

You may opt out of DeepReel using your personal information and customer content for AI model training or model improvement by emailing support@deepreel.com. Please include the email address associated with your account and a clear statement that you wish to opt out of AI model training. The opt-out will apply prospectively after we process your request and will not require DeepReel to remove information already used to train, evaluate, or improve models before the opt-out took effect, except where required by applicable law.

Even if you opt out of AI model training or model improvement, DeepReel may continue to process personal information and content for non-model-training purposes, including to provide and operate the Services, maintain accounts, generate requested outputs, store projects, process payments, provide support, debug and repair errors, improve non-model product features, conduct analytics, enforce our Terms of Service and Acceptable Use Policy, detect and prevent abuse, maintain safety and security, comply with law, and generate aggregate or deidentified information.

Where we use information for model training or improvement, we may use technical and organizational measures designed to reduce direct identifiability where appropriate, such as filtering, aggregation, deidentification, access controls, and internal use restrictions.

7. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, SDKs, local storage, and similar technologies to operate the Services, remember preferences, authenticate users, secure accounts, understand usage, measure performance, improve features, and deliver or measure marketing.

Cookies and similar technologies may include:

  • Strictly necessary technologies. Required for authentication, security, fraud prevention, routing, load balancing, and core service functionality.
  • Analytics and performance technologies. Used to understand how the Services are used, diagnose issues, improve features, and measure performance.
  • Preference technologies. Used to remember settings, preferences, language, region, and other choices.
  • Marketing technologies. Used to measure campaigns, understand referrals, and deliver or evaluate marketing where permitted by law.

You can manage cookies through your browser settings and, where available, through any cookie controls we provide. Blocking cookies may affect your ability to use certain features. Where legally required, we will seek consent for non-essential cookies or provide applicable opt-out choices. Where required by applicable law and technically feasible, we will treat legally recognized opt-out preference signals as requests to opt out of applicable tracking activities.

8. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

  • Affiliates. We may disclose information to our affiliates, including DeepReel Limited, for the purposes described in this Policy.
  • Vendors and service providers. We may disclose information to vendors who provide hosting, cloud storage, AI infrastructure, payment processing, customer support, analytics, security, fraud prevention, content moderation, email delivery, CRM, marketing, debugging, logging, and other operational services.
  • Payment processors. Payment-related information may be processed by third-party payment processors. Their processing is subject to their own terms and privacy notices.
  • Other users and collaborators. If you share projects, outputs, templates, workspaces, links, or content with other users or third parties, those recipients may access the information you choose to share.
  • Integrations and third-party services. If you connect or use integrations, we may disclose information to the third-party service as necessary to provide the integration or as directed by you.
  • Business customers and workspace administrators. If your account is part of an organization, workspace, team, or customer account, administrators and authorized users may access account, usage, project, billing, and content information associated with that workspace.
  • Safety, legal, and enforcement recipients. We may disclose information to law enforcement, regulators, courts, rightsholders, safety organizations, platforms, or other parties where we believe disclosure is required or appropriate to comply with law, enforce our policies, protect rights, prevent harm, investigate misuse, or maintain safety and security.
  • Corporate transaction recipients. We may disclose information in connection with a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, diligence process, or similar corporate transaction.
  • With your consent or direction. We may disclose information when you authorize us to do so or direct us to share it.

We do not sell personal information for monetary consideration. Some uses of advertising or analytics technologies may be considered a "sale," "sharing," or "targeted advertising" under certain U.S. state privacy laws. See Section 14 for more information about applicable opt-out rights.

9. Customer Content and Business Customer Data

When you use DeepReel on behalf of a company, organization, agency, client, employer, or other business customer, you are responsible for ensuring that you have the right to submit personal information, content, images, videos, voice data, likeness data, and other materials to the Services. You must provide any required notices, obtain any required consents, and comply with all applicable privacy, data protection, biometric, employment, marketing, consumer protection, and publicity-rights laws.

If you are an administrator or authorized user of a business customer account, we may process information about users within your organization to provide the Services, administer the account, manage permissions, monitor usage, support billing, and enforce customer agreements and policies. Your organization may have access to information associated with your use of the organizational account.

If you believe personal information about you has been submitted to DeepReel by a DeepReel customer, you should first contact that customer directly. You may also contact support@deepreel.com, and we will direct or handle your request as appropriate based on our role and legal obligations.

10. International Data Transfers

DeepReel is a global service. We may process, store, and transfer personal information in the United States, the United Kingdom, and other countries where we, our affiliates, vendors, or service providers operate. These countries may have privacy laws that differ from those in your jurisdiction.

Where required by applicable law, we rely on appropriate transfer mechanisms, such as adequacy decisions, standard contractual clauses, data processing terms, consent, or other lawful mechanisms. We do not claim participation in the EU-U.S. Data Privacy Framework, UK Extension, or Swiss-U.S. Data Privacy Framework unless and until DeepReel separately certifies and publishes such certification.

11. Retention of Personal Information

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain your account, store projects and outputs, process subscriptions and credits, comply with legal obligations, resolve disputes, enforce agreements, prevent abuse, maintain security, and support legitimate business purposes.

Retention periods may vary depending on the type of information, the feature used, your plan, your account settings, legal requirements, backup cycles, safety needs, and customer agreements. For example, account and billing records may be retained for tax, accounting, and legal purposes; support records may be retained to resolve issues; and content may be retained while your account, project, or workspace remains active.

When personal information is no longer needed, we may delete, anonymize, aggregate, or deidentify it. Information may remain in backups, logs, archives, or disaster recovery systems for a limited period, subject to our retention and security practices.

Retention of biometric identifiers and biometric information is governed by Section 4A and is limited to the period stated there.

12. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These measures may include access controls, encryption, logging, monitoring, vendor review, security testing, incident response procedures, and internal policies.

No method of transmission or storage is completely secure. We cannot guarantee that personal information will always remain secure. You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying us at support@deepreel.com if you believe your account or credentials have been compromised.

13. Your Privacy Choices and Rights

Depending on where you live and the nature of your relationship with DeepReel, you may have certain rights regarding personal information. These rights may include the right to request access, correction, deletion, portability, restriction, objection, withdrawal of consent, opt-out of marketing, opt-out of targeted advertising, opt-out of certain sharing or sales, and opt-out of AI model training or model improvement.

You may exercise privacy rights by emailing support@deepreel.com. Please include your name, account email address, location, the right you wish to exercise, and enough information for us to verify and process your request. We may ask for additional information to verify your identity or authority. Authorized agents may submit requests where permitted by law, but we may require proof of authorization and may require you to verify your identity directly.

You may opt out of marketing emails by using the unsubscribe link in the email or by contacting support@deepreel.com. You may opt out of AI model training or model improvement by emailing support@deepreel.com as described in Section 6.

We will not discriminate against you for exercising rights available under applicable privacy laws. However, some requests may limit our ability to provide certain Services, features, outputs, or account functionality.

14. Additional U.S. State Privacy Disclosures

This section provides additional information for residents of U.S. states with comprehensive privacy laws, including California and other states where applicable. The categories below describe our practices generally and may not apply to every user or every Service feature.

We may use and disclose sensitive personal information for the purposes described in this Policy, including providing the Services, account administration, security, fraud prevention, safety, AI model research and improvement, and legal compliance. If you are a California resident, you have the right to limit our use and disclosure of sensitive personal information to those purposes specified in Section 1798.121 of the California Civil Code. You may exercise this right by emailing support@deepreel.com.

We do not knowingly sell or share personal information of individuals under 18. We do not sell personal information for money. To the extent our use of advertising or analytics technologies is considered a sale, sharing, or targeted advertising under applicable law, you may opt out by using available cookie controls or by contacting support@deepreel.com.

15. European, UK, and International Privacy Disclosures

If you are located in the European Economic Area, the United Kingdom, Switzerland, Brazil, India, or another jurisdiction with privacy or data protection laws, additional rights or disclosures may apply.

Where required, our legal bases for processing may include performance of a contract, legitimate interests, consent, compliance with legal obligations, protection of vital interests, establishment or defense of legal claims, and other legal bases recognized by applicable law. Examples include:

  • Contract. Providing the Services, generating outputs, creating accounts, processing payments, and providing customer support.
  • Legitimate interests. Maintaining and improving the Services, security, fraud prevention, analytics, product development, safety, enforcement, customer communications, and business operations, where not overridden by your rights and interests.
  • Consent. Certain cookies, marketing, sensitive data processing, or other processing where consent is required by law.
  • Legal obligations. Tax, accounting, sanctions, export controls, court orders, regulatory requests, and other compliance obligations.
  • Legal claims and safety. Protecting DeepReel, users, third parties, and the public from misuse, fraud, impersonation, security incidents, or unlawful activity.

Depending on your location, you may have rights to access, correct, delete, restrict, object, withdraw consent, request portability, opt out of certain processing, or lodge a complaint with a supervisory authority. You may contact us at support@deepreel.com to exercise rights or ask questions about our processing.

United Kingdom representative. For data subjects in the United Kingdom, our designated representative under Article 27 of the UK General Data Protection Regulation is DeepReel Limited, 29 Highcroft Industrial Estate, Enterprise Road, Waterlooville, England, PO8 0BT, reachable at support@deepreel.com. You may contact our UK representative on matters relating to the processing of your personal information in connection with the UK GDPR.

Data Protection Officer. DeepReel’s designated Data Protection Officer is appointed through DeepReel Limited, 29 Highcroft Industrial Estate, Enterprise Road, Waterlooville, England, PO8 0BT. You may contact the Data Protection Officer at support@deepreel.com.

16. Children's Privacy

The Services are not intended for individuals under 18, and users must be at least 18 years old to use the Services. We do not knowingly collect personal information from children under 13 or knowingly allow individuals under 18 to create accounts.

You may not upload, submit, or use the image, voice, likeness, biometric information, or personal information of a minor with the Services unless you have all required rights, consents, and legal authority and the use is permitted by our Terms of Service and Acceptable Use Policy. If you believe a minor's personal information has been provided to DeepReel improperly, contact support@deepreel.com.

17. Third-Party Services and Integrations

The Services may contain links to, or integrations with, third-party websites, platforms, applications, services, payment processors, cloud providers, analytics tools, advertising networks, social media platforms, or AI service providers. We are not responsible for the privacy practices of third parties. Your use of third-party services is subject to their own terms and privacy policies.

If you choose to share DeepReel outputs or content through third-party platforms, or connect DeepReel with third-party integrations, those third parties may collect or process personal information according to their own policies. You should review those policies before using third-party services or sharing information with them.

18. Changes to this Policy

We may update this Policy from time to time. When we do, we will update the "Last Updated" date above. If we make material changes, we will provide notice where required by law or where we believe notice is appropriate. Your continued use of the Services after an updated Policy becomes effective means that you acknowledge the updated Policy.
